The legislation regarding surrogacy in X SURROGACY Kyrgyzstan has been established to regulate and govern the practice.
The Reproductive Rights Law of the Kyrgyz Republic, specifically Article 18 to 21, permits the practice of surrogacy for individuals who are unable to conceive a child due to medical reasons. In order to proceed with this method of reproduction, a notarized contract is required. If the surrogate mother is married, the consent of her spouse is also necessary. The Law sets certain criteria for the surrogate mother, including being between the ages of 20 and 40, being in good mental and physical health, having at least one biological child, and passing medical and genetic tests. Additionally, married couples who enter into a contract for surrogacy are responsible for covering all financial expenses related to the surrogate mother's pregnancy, labor, and postpartum period.
Kazakhstan Surrogacy Overview
Surrogacy in Kazakhstan presents a legal and cost-effective option for prospective parents looking to expand their families. The country's surrogacy laws are favorable, enabling intended parents to establish legal parentage from the outset. Moreover, the expenses associated with surrogacy in Kazakhstan are notably lower compared to other nations. Nevertheless, it is crucial to engage with a reputable surrogacy agency that possesses the necessary experience to ensure a seamless and successful surrogacy journey in Kazakhstan. Many countries have stringent laws that either restrict or prohibit surrogate parenting, egg donation, sperm donation, and in-vitro fertilization services. Kazakhstan stands out as one of the few nations with progressive reproductive technology laws. The utilization of reproductive technologies, including third-party reproductive services, is permitted for both local and foreign couples. The country boasts advanced medical technology in the field of assisted reproductive technology (ART), placing it on par with neighboring countries. In Kazakhstan, only gestational surrogacy is permitted under the Family Code of the Republic of Kazakhstan. This form of surrogacy involves a woman carrying and delivering a child for an infertile couple without a genetic connection to the child. Through the in-vitro fertilization (IVF) process, embryos are created using the eggs from the mother or an egg donor and the sperm of the intended parents or donors. These resulting embryos are then transferred to a gestational carrier in the hopes of successful implantation.
